Bylaws and Policy Review 2019

What is a bylaw?

Bylaws are rules made by Council under the Local Government Act 2002 (the “Act”). They are created for the purpose of:

  • Protecting the public from nuisance;
  • Protecting, promoting, and maintaining public health and safety; and
  • Minimising the potential for offensive behaviour in public places.

Bylaws are also made to regulate activities such as solid waste and to manage, regulate and protect Council infrastructure from damage, misuse or loss, including the public water supply network and cemeteries.

What bylaws are being reviewed?

The Manawatū District Council is reviewing the following bylaws:

  • Animal Bylaw 2014
  • Cemeteries Bylaw 2014
  • Dog Control Bylaw 2014
  • Solid Waste Bylaw 2015
  • Water Supply Bylaw 2015

Why are the bylaws being reviewed?

The Act requires that a bylaw is reviewed within five years of it being made. The Animal, Cemeteries and Dog Control Bylaws came into force on 1 November 2014. They will expire on 1 November 2019. The Solid Waste and Water Supply Bylaws came into force on 21 December 2015. They will expire on 21 December 2020.

REVIEW OF THE DOG CONTROL POLICY

Section 10(1) of the Dog Control Act 1996 requires every council to adopt a policy in respect of dogs in their District. The Dog Control Act 1996 requires councils to review their Dog Control Policy if the bylaw that implements the policy requires review.

As the Manawatū District Council is reviewing its Dog Control Bylaw 2014, the review of the Dog Control Policy 2014 is being done at the same time. This ensures that the Dog Control Policy and Bylaw remain consistent.

Where are we at in the review?

The proposed bylaws and Dog Control Policy have been approved for public consultation. Those interested in the proposal have until 5pm on the 5th of September 2019 to make a submission on one or more of the draft bylaws and policy by clicking on the links below. Submitters should note that their submission will be made publicly available at the close of submissions.

Council completed pre-consultation on topics related to the Animal and Dog Control Bylaws in March 2019. The results of this pre-consultation can be found on this website by clicking on the respective bylaw tiles. Feedback received from pre-consultation informed the drafting of these bylaws.

Council has also consulted with key stakeholders in relation to topics within the Animal and Cemeteries Bylaws.

Next Steps

A hearing will be held for those wanting to present their views to the Hearings Committee on 16 September 2019.

Those who indicate they wish to speak to their submission will be allocated a speaking time following the close of submissions.

The Hearings Committee will deliberate on submissions on 27 September 2019, with the final versions of the bylaws and policy scheduled for adoption by Council on 10 October 2019.
