- Information about how many proposals to stop the legal road adjoining 524 Opawe Road, in Pohangina have been made since 2000.
There have been two proposals under Schedule 10 of the Local Government Act 1974 to stop the legal road adjoining 524 Opawe Road since 2000. One proposal was made in 2011, and another was made in 2021. For further information, the two Council reports initiating those proposals are provided alongside this response.
- Information about who proposed the road be stopped in each case above, focusing particularly on whether the proposal was by Council, another public body, an adjoining landowner or a private individual or group.
In both instances, and as can be seen in the Council reports provided, Council officers proposed the road stopping. Specifically, the 2011 proposal for the road stopping proposal was made by the Council's Roading Manager at the time, and the 2021 proposal was made by Wendy Thompson (an Infrastructure Planner) with assistance from Ryan O'Leary (a consultant planner).
- The total money spent by the Council since 2000 on the proposed road stopping in each case above including on lawyers, surveyors, The Property Group and other contractors but excluding expenditure associated with litigation in the District Court. To clarify, the purpose is to understand expenditure on the Council's administrative processes of considering and deciding on proposals to stop the road referred to above rather than expenditure responding to the District Court litigation about the road.

Fluoride levels are monitored constantly by online instruments. The instruments are validated daily by our operations team using a bench top analysis and a sample is sent weekly to our contracted laboratory.
How much does the Council spend on fluoridation chemicals and equipment maintenance each year?
On average MDC spends approximately $3,620 (excl.GST) on fluoride for the Feilding water supply with service and maintenance of the equipment costs approximately $1,200 per annum.
Can the council please provide community drinking water fountains with fluoride (and chlorine) free water?
All water supplied by Council across the District is Chlorinated and in Feilding treated fluoride. These are in line with Taumata Arowai drinking water requirements and under the current drinking water regulations, Council are unable to supply unchlorinated drinking water.

Initially this was an area of road reserve, but after Londons Ford Road was realigned prior to 1965, the title was created after a re-survey. Council planted radiata in 1965 and harvested in 1995. Then the latest crop was planted in 1997.

a . MDC does not charge time to other councils when the Senior Emergency Management Officer delivers training on behalf of the CDEM Group either at a central location or locally. This is a reciprocal arrangement within the Region as capability development is part of all the Emergency Management Officer’s roles, to ensure that councils are able to fulfil their legislated requirements to provide emergency management responses and as such, a coordinated approach is applied in the Manawatu Whanganui CDEM Group.
There is no specific spend on training and planning as this is part of the role for FTE Emergency Management Team. They are responsible for facilitating and assisting in Emergency Management training for all council staff both here at MDC and in the wider Regional CDEM Group, who are all required to complete Emergency Management training as part of their roles. However, a budget is provided to cover the sundry costs of printing and catering where required. This falls under a budget line entitled ‘Training & Development’ and has been as follows;

b. There are two (2) FTE council staff in the Emergency Management Team. There have been two periods, December 2022 – April 2023 and January 2024 – May 2024 where there was one (1) FTE in role due to staff resignations and recruitment processes.
• As of 16th July 2024, we have 172 staff across all council, from CE downwards. It is a requirement that all staff complete the minimum standard of EM training as defined by the NEMA hosted Integrated Training Framework (ITF) platform. As part of the staff induction process, all staff receive an Emergency Management input and brief overview of our hazards and expectations.
With regard to the formal training, we are currently showing;
75% of all staff having completed the ITF Foundation Training.
52% of total staff have gone on to complete the ITF Intermediate Training.
Three staff members have completed the Response & Recovery Aotearoa New Zealand Tier 1 Leadership Course.
• As per question 1, there is no specific training budget as it is part of the Emergency Management Teams role and Council actively encourages and supports staff members to attend training sessions held at MDC as well as in the wider Region.
There is an annual training and development budget of $2297 which is for printing training materials and tea & coffee as required. There are no plans or budget available to increase the FTE establishment within the Emergency Management Team.

The MDC Road Maintenance Contract 1505 is for the roading network within Manawatū District Council’s jurisdiction. This contract includes the maintenance, and renewal works on the local road network. The contractor provides all labour, plant and materials required to undertake and complete the works included in the accepted contract programmes in accordance with the contract documents or the instruction of the Engineer.
The Road Maintenance Contract 1505 is 297 pages long, excluding Appendices. Most of the contract is not applicable to your questions so has not been supplied. You are however welcome to view the contract at our office if you so desire.
Payment is made per pothole for the identification, complete repair and recording of pothole repairs throughout the sealed road network, maintained in accordance with Maintenance Specification Section 6 Clause 5 (reproduced at the end of this response for your convenience).
The rate is an all-inclusive rate per pothole required for the identification, complete repair and recording of all potholes as defined by the level of service nominated in Maintenance Specification Section 6 Clause 5 within the sealed road network at all times during the period of the month.
The contractor tendered $2.41 in 2015, the contract has a cost fluctuation clause which allows for tendered rates to be adjusted in line with inflation (see Contract price adjustment for cost fluctuation: infrastructure contracts (nzta.govt.nz). The average all-inclusive rate for each pothole repair carried out during the 2023-24 financial year was $6.63.
The Contractor is required to use RAMM Contractor and the RAMM database for contract management tasks such as (but not limited to) entering jobs, creating work programmes, prioritising work, entering claims, producing reports, monitoring job progress, asset detail updates, contract claim preparation, tracking service requests. It is required that the system is updated continuously through monthly claim periods, as work is completed, to allow for timely completion of claims and asset updates.
The Engineer interrogates the claim and audits the quality of data entered into RAMM and RAMM Contractor. If the data is found to be incomplete or erroneous, the Engineer will hold the associated claim line on the basis that the data is not acceptable, the claim line can be represented by the contractor once the data is correct. 5 Potholes
Based on TNZ HM19:2006
5.1 Scope
This Section sets out the requirements for repairing potholes in sealed roads.
5.2 Definition
A hole in the Pavement, frequently round in shape, resulting from loss of Pavement material caused by the action of traffic. As a defect, potholes are defined as:
a) Where surface attrition has occurred in areas of Pavement, over an area greater than 100mm in diameter but not exceeding 1m2, and the underlying Pavement is exposed. (This does not include Scabbing and Stripping on a chip seal),
b) Where the defect exceeds 50mm depth in Asphaltic Concrete, including porous asphalt and/or surfacing layers.
5.3 Response Times
All potholes shall be repaired within the response times set out in Appendix 1.4.
5.3.1 Large Potholes
If an individual pothole exceeds 1m2 in area, the Contractor must:
a) within the response times, provide the most practical repair that is reasonably possible given the conditions of the surrounding pavement.
b) notify the Engineer in writing, within 24 hours of first observing and repairing the pothole, of the location of the area of pavement which is considered to have failed or is unsound, and the proposed method of permanent repair.

5.3.2 Unstable Pavement
When, in the opinion of the Contractor, the pothole is due to underlying instability of the road pavement, the Contractor shall report such potholes after repair to the Engineer.
5.4 Specific Requirements
5.4.1 Repair Method
The immediate area surrounding the pothole shall be excavated to remove distressed material.
Ragged and/or proud edges shall not be permitted and vertical squaring up of the existing edge around the perimeter of the area to be treated is required. In unbound granular materials the sides of the excavation shall be trimmed to a battered slope.
The Contractor shall select the repair method most appropriate to correct the defect. The materials used shall comply with TNZ M/ 10 or any other mix approved by the Engineer.
5.4.2 Temporary Repair Method
When the weather is unsuitable for a permanent repair, the pothole will be filled with a suitable material to make the area safe until a permanent repair can be affected.
5.4.3 Surfacing
The finished running surface of the repair shall be waterproof, dense and stable and not move under the action of traffic.
5.5 Performance Criteria
The performance of the Contractor during the Contract period will be measured by the following criteria:
a) the safety of road users is not impaired due to potholes not being repaired
b) potholes are repaired within the response times required
c) the pothole repair remains intact
d) repaired potholes continue to remain waterproof and maintain a smooth riding surface
e) there is no flushing or bleeding of the surface of potholes
f) appropriate notification to the engineer within the response time required, of individual potholes exceeding 1m2 and/or where unstable
g) the excavation of the repaired area is carried out in such a manner that the integrity of adjacent sections of pavement is not disturbed
h) The finished surface of the repair shall match the general profile of the adjacent surface have no sharp ridges and shall be such that it does not allow water to pond nor is higher than the adjacent pavement by more than 10mm when measured by a 2m straightedge.

Fluoride Measurements for Almadale Water Treatment Plant and Awa Street Treatment Plant, which both supply Feilding, are provided in this link - LINK.
