Building Consent Complaint Process

Complaints provide us with valuable feedback about our services and customer experience. They also give us the opportunity to improve how we deliver building control functions.

You have the right to:

  • Appeal any decision we have made about your building consent.
  • File a complaint about our work in building control.

Building control includes activities such as:

  • Lodging or vetting building consent applications
  • Processing building consent applications
  • Inspecting work under construction
  • Issuing a Notice to Fix, Code Compliance Certificate, or Compliance Schedule
  • Meeting statutory timeframes
  • Charging fees and charges
  • Ensuring compliance with legislative or Building Code requirements

You can make a complaint in person, by phone, by email, or in writing:

  • Date the issue occurred
  • Nature of complaint (e.g. vetting, processing, inspection, Notice to Fix, CCC, compliance schedule, fees, timeframes, legislative compliance)
  • Copies of any supporting information (if applicable)
  • Your relationship to the matter (e.g. customer, regulator, stakeholder)
  • Your name and contact details

  • We will acknowledge your complaint within 5 working days.
  • We will investigate your concerns fairly and objectively.
  • We aim to provide a full response within 10 working days. If the matter is complex, we will update you on progress and timeframes.
  • All complaints are logged and tracked to ensure transparency.

If you don’t agree with the outcome, you may ask us to review the decision. Please make appeals in writing, explaining why you disagree. Address your appeal to:

If you remain dissatisfied, you may apply to the Ministry of Business, Innovation and Employment (MBIE) for a Determination. MBIE will consult all parties and issue a binding decision. See more information on the MBIE Building Performance website:

You can apply to the Ministry of Business, Innovation and Employment (MBIE) for a determination

Determinations can look at whether a building or building work complies with the building code or if you can’t agree with Council's decision about building work, a determination can assist you solving the problem.

They are not for civil disputes or disputes about workmanship.
