I refer to your Local Government Official Information Request dated 26 March 2025, in which you seek information relating to buildings identified as dangerous, affected, or insanitary under Sections 121 to 123 of the Building Act 2004.
In summary, from 1 January 2020 to the present, the Council has issued seven notices. Of these, four were classified as dangerous and three as insanitary. Five of the seven notices have been lifted following compliance. There is no record in councils document management system of the remaining two notices being lifted. For further information, please refer to the attached documentation.
Please note that Council holds no records of dangerous, affected, or insanitary notices in its document management system prior to 1 January 2020. Any earlier notices may exist only in hard copy within individual property files. Retrieving this information would require a manual review of the property files, which is a time-intensive process. Therefore, council is refusing this request under Section 17 (f) of the Official Information Act (1982) "That the information requested cannot be made available without substantial collation or research."
Should you wish to proceed with this request, please be aware that staff time will be charged as follows:
- The first hour of staff time is free of charge.
Each subsequent half-hour (or part thereof) is charged at $38.00.

The activity on the property is a rural production activity therefore it is exempt from having to follow specific noise level rules as laid out according to NOISE-ST2.
Section 16 of the RMA - Duty to avoid unreasonable noise
- Every occupier of land (including any premises and any coastal marine area), and every person carrying out an activity in, on, or under a water body or the coastal marine area, shall adopt the best practicable option to ensure that the emission of noise from that land or water does not exceed a reasonable level.
- A national environmental standard, plan, or resource consent made or granted for the purposes of any of sections 9, 12, 13, 14, 15, 15A, and 15B may prescribe noise emission standards, and is not limited in its ability to do so by subsection (1).

This consent is attached - LC3747 – Granted to Byfords Construction Co Ltd on 19 August 1999 for the extraction and processing of gravel from river berm. No further details are held regarding the area outlined in red.
