I got your voice message and tried to ring back but it went to voicemail. I thought it better to reply in writing.
In response to the various questions raised in your LGOIMA request received 18 April 2018, you will see from the attached map, that the property you own is 1761 Cheltenham/Hunterville Road. The area is marked in Yellow This is determined by the attached Quotable Valuation References.
Property 1763A is owned by Chorus New Zealand (formerly would have been known as Telecom). As marked in black dotted line. As you are probably aware, the access goes from Cheltenham Hunterville Road, between your boundary and that of Mr Taylor, and around to the chorus telephone exchange.
Any designation in favour of Telecom would never have been mentioned to you as part of your enquiries, because you were purchasing 1761, as the attached plan shows. There is no designation as such, because the property marked as 1763A is actually owned by Chorus.
This will also answer your question about who is using and paying rates for 1763A. It is owned, used and rates paid by Chorus.
As we have suggested to you previously, you should take independent legal advice to clarify exactly what piece of property you did purchase, as all of our records show that you purchased 1761, as shown in yellow, which is made up of two titles of 534 sq.m and 741 sq.m.
As previously emailed to you, it does appear that the advice given to you in 2006 was correct.
