| Response: | Number of claims brought against Council in the calendar year, relating to its functions and performance under the Building Act 1991 and/or 2004, including granting building consents, carrying out inspections and/or issuing Code Compliance Certificates (Building Defect Claims) We have been able to easily identify 3 claims, one each for the years 2005, 2010 & 2015. Any details other than these cannot be accessed without substantial research and collation and is therefore refused under section 17(f) of the Local Government Official Information and Meetings Act. Total amount (including GST if any) Council paid out in settlements and/or judgments for building defect claims in the calendar year We are unable to release this information as the settlements were confidential, therefore refused under section 7(2)(c) of the Local Government Official Information and Meetings Act – subject to an obligation of confidence.
